What Exactly is a Statute of Limitations?

A statute of limitations is a law that sets a maximum time limit for a legal action to be filed after the incident or injury has occurred. For example, if your state has a two-year statute of limitations for personal injury claims, you must file a lawsuit within two years from the date of the accident. If you try to file on the two-year and one-day mark, your case will almost certainly be dismissed.

The purpose of these laws is to ensure fairness and prevent legal disputes from dragging on indefinitely. They provide:

  • Fairness to Defendants: They prevent defendants from having to defend themselves against old claims when evidence may have been lost or forgotten.

  • Contract Disputes: The time limit for suing over a breach of contract can be anywhere from three to six years, and sometimes longer.
  • Property Damage: The statute of limitations for claims involving damage to your property is often shorter, typically around two to three years.
  • Defamation: Lawsuits for libel or slander often have a very short statute of limitations, sometimes as little as one year.

The “Discovery Rule” and Tolling: When Does the Clock Start?

While the statute of limitations seems straightforward, there are situations where the clock’s start date is not so simple.

  • The Discovery Rule: In some cases, the clock doesn’t start ticking on the date of the injury itself, but rather on the date the injury was “discovered” or reasonably should have been discovered. This is common in medical malpractice cases where a patient might not realize they were injured by a doctor’s mistake for months or even years.
  • Tolling: Tolling is the temporary pausing of the statute of limitations. This often happens for minors, as the deadline may not begin until they turn 18. It can also be tolled for people who are mentally incapacitated or if the defendant has left the state.
